Terms of Service

These Terms of Service (“Terms”) are a binding legal agreement between you (“you” or “User”) and Vladdy Ventures LLC (“Vladdy Ventures,” “we,” “us,” or “our”), the operator of EssayStat (the “Service”). By creating an account, signing in, purchasing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

1. The Service

EssayStat uses artificial intelligence to generate draft college-application essays and related materials from information you provide. The Service is a writing and brainstorming aid. Any output is a draft only and is not guaranteed to be accurate, original, error-free, or to result in admission, scholarship, or any other outcome at any institution. We may modify, suspend, or discontinue any part of the Service at any time without liability.

2. Eligibility & minors

The Service is intended for prospective college applicants. You must be at least 13 years old to use it. If you are under the age of majority in your jurisdiction (typically 18), you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use. By using the Service you represent that you meet these requirements and that all information you provide is accurate.

3. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk or legal exposure for us, in our sole discretion and without notice.

4. Your responsibilities & academic integrity

You are solely and exclusively responsible for any content you submit to any college, university, or third party, including content derived from the Service. Many institutions restrict or prohibit AI-assisted application materials and the misrepresentation of authorship. You agree that it is your obligation to (a) ensure any material you submit is truthful and your own work, and (b) review and comply with the academic-integrity, admissions, and AI-use policies of every institution you apply to. We are not responsible for any consequence — including rejection, rescission, disciplinary action, or revoked admission — arising from your use or submission of Service output.

5. Acceptable use

You agree not to: misuse, reverse-engineer, scrape, or overload the Service; submit unlawful, infringing, or harmful content; impersonate others or provide false information; resell or commercially exploit the Service without our written permission; or use the Service in violation of any law or third-party right. We may investigate and take any action we deem appropriate for violations.

6. Payments & refunds

Essays are sold as one-time purchases: $50 to unlock your first essay and $30 to tailor it to each additional school (or as otherwise displayed at checkout). Payments are processed by our third-party processor, Stripe; by purchasing you also agree to Stripe's terms. Because output is delivered digitally and immediately upon unlock, all sales are final and non-refundableexcept where a refund is required by applicable law. You are responsible for all applicable taxes. We may change prices at any time prospectively.

7. Content, licenses & AI training

Your inputs. You retain ownership of the information and writing samples you submit (“Inputs”). You grant Vladdy Ventures a worldwide, royalty-free, sublicensable license to host, process, reproduce, modify, and create derivative works from your Inputs and the generated output (“Output”) for the purposes of operating, securing, improving, and developing the Service.

Use for AI and analytics. You acknowledge and agree that we and our service providers may use your Inputs and Output to operate and improve the Service, to develop, train, fine-tune, and evaluate machine-learning and AI models and features, and for research and analytics. Where we use data for model training or product improvement beyond simply generating your essay, we will use de-identified or aggregated data where reasonably practicable. You represent that you have all rights necessary to grant this license and that your Inputs do not infringe any third party's rights.

Output. As between you and us, and subject to your payment and these Terms, you may use the Output you purchase for your personal application purposes. AI-generated Output may be non-unique and similar to output provided to others; we make no representation that Output is original or protectable.

8. Intellectual property

The Service, including its software, design, text, school catalogue, and branding, is owned by Vladdy Ventures and protected by intellectual-property laws. Except for the limited rights expressly granted to you, no rights are transferred. “EssayStat” and our logos are our trademarks and may not be used without permission.

9. No affiliation; third parties

EssayStat is not affiliated with, endorsed by, or sponsored by any college, university, the Common Application, or any other organization referenced on the Service. School names, mottos, and missions are used for identification and educational purposes only. The Service relies on third-party providers (including Anthropic and Stripe); we are not responsible for their acts, omissions, or availability.

10. Disclaimer of warranties

THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, ORIGINALITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT OUTPUT WILL MEET ANY INSTITUTION'S REQUIREMENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VLADDY VENTURES AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF ADMISSION, OPPORTUNITY, REPUTATION, DATA, OR PROFITS, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold harmless Vladdy Ventures and its owners, members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your Inputs, your Output, your submissions to any institution, your violation of these Terms, or your violation of any law or third-party right.

13. Governing law & dispute resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively through binding individual arbitration seated in, or in the state or federal courts located in, Travis County, Texas, and you consent to that jurisdiction and venue. To the extent permitted by law, you and we waive any right to a jury trial and to participate in a class action. Any claim must be brought within one (1) year after it arises.

14. Changes to these Terms

We may update these Terms from time to time. The “Effective date” above reflects the latest version. Material changes will be posted here, and your continued use of the Service after changes take effect constitutes acceptance.
